1. Overview and Acceptance

This website, including all information, products, features, tools, and services available through it, is operated by Pressure Equipment Sales LLC, referred to in these Terms as “PES,” “we,” “us,” or “our.”

These Terms of Service apply to pes-online.com and any related pages, features, purchases, accounts, and services offered through the website, collectively referred to as the “Site.”

By accessing the Site, creating an account, submitting an order, or purchasing a product, you agree to these Terms of Service and the policies incorporated into them, including our:

  • Refund and Return Policy
  • Privacy Policy
  • Shipping Policy, when posted
  • Product-specific instructions, warnings, and restrictions

If you do not agree to these Terms, do not use the Site or purchase products through it.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform used to offer our products and services.

2. Eligibility

You must be at least the age of majority in your state or place of residence to make a purchase, or you must make the purchase with the involvement and permission of a parent or legal guardian.

Certain products sold by PES, including automotive detailing chemicals, concentrates, coatings, aerosols, tools, and equipment, are intended to be purchased and used by responsible adults.

Our products are not intended for use by children.

You may not use the Site or our products for an unlawful or unauthorized purpose.

3. Customer Accounts

You are responsible for:

  • Providing accurate, complete, and current information
  • Maintaining the confidentiality of your account credentials
  • Restricting unauthorized access to your account or device
  • All activity conducted through your account
  • Promptly notifying us of suspected unauthorized account activity

We may suspend or close an account when we reasonably believe it is being used for fraud, abuse, unauthorized resale, discount manipulation, unlawful activity, or violations of these Terms.

4. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, sizes, prices, availability, directions, safety information, and other content are accurate.

Product colors and appearance may vary based on lighting, packaging updates, manufacturing changes, screen settings, and device displays.

Packaging, labels, product appearance, and minor specifications may change without notice when those changes do not materially alter the product.

If website information appears to conflict with a product label, Safety Data Sheet, or manufacturer instructions, do not use the product until you contact PES for clarification.

Products and packaging shown in photographs may include display items or accessories that are not included unless specifically identified in the product description.

We reserve the right to correct typographical, pricing, inventory, product-description, or technical errors.

5. Product Safety and Proper Use

Automotive detailing products must be used only for their intended purpose and according to all applicable:

  • Product labels
  • Instructions and dilution ratios
  • Precautionary statements
  • Safety Data Sheets
  • Surface-compatibility requirements
  • Storage and disposal instructions
  • Manufacturer warnings
  • Laws and regulations

Before using a product, you agree to:

  • Read the complete label and instructions
  • Review the Safety Data Sheet when applicable
  • Use appropriate gloves, eye protection, ventilation, or other protective equipment
  • Test the product on a small, inconspicuous area
  • Confirm that the product is compatible with the intended surface
  • Keep the product away from children and animals
  • Follow all storage, temperature, transportation, and disposal requirements

Do not mix products unless the label or written manufacturer instructions specifically authorize mixing.

Do not apply products to people, animals, plants, food, food-contact surfaces, or unintended materials unless the product instructions specifically permit that use.

PES is not responsible for damage resulting from misuse, improper dilution, improper storage, contamination, mixing incompatible products, application to an incompatible surface, failure to test, or failure to follow the product label and instructions.

Nothing on the Site replaces the product label, Safety Data Sheet, professional judgment, or applicable safety requirements.

If a product is subject to a recall or safety notice, customers must stop using it and follow the instructions provided by PES or the manufacturer.

6. Orders and Order Acceptance

Submitting an order does not guarantee acceptance.

An order confirmation acknowledges that we received your order. An order is accepted when it is fulfilled, shipped, made ready for pickup, or otherwise expressly accepted by PES.

We may reject, limit, place on hold, or cancel an order for legitimate reasons, including:

  • Product unavailability
  • Inventory discrepancies
  • Obvious pricing or technical errors
  • Payment authorization problems
  • Suspected fraud or unauthorized transactions
  • Incorrect billing or shipping information
  • Shipping restrictions
  • Product-safety or carrier restrictions
  • Suspected promotional, bundle, or discount abuse
  • Violations of these Terms

If we cancel a paid order, we will refund the cancelled amount to the original payment method. If only part of an order is cancelled, we will refund the cancelled products and any applicable shipping charges associated solely with those products.

We may limit quantities purchased per customer, account, household, payment method, billing address, shipping address, promotion, or order when reasonably necessary to protect inventory or prevent abuse.

Commercial, wholesale, dealer, or resale purchases may be subject to additional terms.

7. Prices, Payments, and Taxes

Prices are displayed in the currency shown on the Site and may change without notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious pricing, promotional, or technical errors before fulfillment.

Customers authorize PES and its payment providers to charge the selected payment method for:

  • Products
  • Shipping and handling
  • Applicable taxes
  • Other charges clearly disclosed before order submission

Customers must provide accurate billing and payment information and represent that they are authorized to use the selected payment method.

Applicable taxes are calculated based on the order, products, shipping destination, and legal requirements.

8. Bundles, Discounts, and Promotions

Bundles, kits, discount codes, automatic discounts, promotional offers, and sale prices are subject to their stated eligibility requirements, dates, quantities, products, variants, and limitations.

Unless expressly stated otherwise:

  • Discounts cannot be combined.
  • Promotions have no cash value.
  • Discounts apply only to eligible products and quantities.
  • Percentage discounts do not stack on the same product.
  • Purchasing multiple eligible bundles does not add their percentage discounts together on an individual item.
  • A promotion may be changed or ended before an order is submitted.
  • Discounts cannot be applied retroactively to completed orders.
  • Taxes, shipping, gift cards, and excluded products may not qualify.

Customers may not manipulate or attempt to manipulate:

  • Product or variant identifiers
  • Bundle identifiers
  • Cart attributes or line-item properties
  • Quantities required for a discount
  • Product prices
  • Discount eligibility
  • Promotional codes
  • Checkout requests
  • Storefront or Cart API data

We may reject or cancel an order involving unauthorized discount use, technical exploitation, automated abuse, altered cart data, obvious promotional errors, or products that do not satisfy the promotion’s requirements. Any valid amount collected for a cancelled order will be refunded.

Terms displayed with a specific promotion control if they conflict with the general promotional provisions in these Terms.

Returns involving kits and bundles are subject to the complete-bundle requirements in our Refund and Return Policy.

9. Shipping and Delivery

Shipping options, charges, and available destinations are displayed during checkout when available.

Processing and delivery dates are estimates unless PES expressly provides a written guarantee. Delivery may be affected by carriers, weather, holidays, inventory, hazardous-material restrictions, incorrect addresses, and events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address, refused package, failed delivery, or unclaimed shipment may be charged to the customer to the extent permitted by law.

Certain chemicals, liquids, aerosols, pressurized containers, oversized products, and hazardous materials may:

  • Require a particular carrier or shipping method
  • Be restricted from air transportation
  • Be unavailable in certain locations
  • Be ineligible for expedited shipping
  • Require additional handling or documentation

We may cancel and refund products that cannot legally or safely be shipped to the provided destination.

Customers should inspect packages promptly and report damaged, leaking, missing, or incorrect products according to our Refund and Return Policy.

Do not return a leaking, damaged, pressurized, flammable, or potentially hazardous product without instructions from PES.

10. Local Pickup

When local pickup is available, customers must wait for confirmation that the order is ready before arriving.

We may require the order confirmation, government-issued identification, or confirmation from the purchaser before releasing an order.

Pickup availability, hours, and locations may change. Products not picked up within the communicated period may be cancelled or handled according to instructions provided with the order.

11. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, damaged-product claims, and bundle returns are governed by our Refund and Return Policy.

Unless an approved exception applies, return-eligible products must be:

  • Requested within 30 calendar days after delivery
  • Unopened and unused
  • In new, resalable condition
  • In their complete original packaging
  • Returned with all seals, labels, components, accessories, and promotional items

Opened, used, tested, sprayed, applied, installed, filled, diluted, mixed, contaminated, altered, or partially consumed products are not accepted.

A kit or bundle must be returned as a complete set. Individual bundle components cannot be returned separately.

The complete Refund and Return Policy controls if this summary conflicts with that policy.

12. Prohibited Uses

You may not use the Site, its content, or its services to:

  • Violate any applicable law or regulation
  • Commit or facilitate fraud
  • Submit false or misleading information
  • Infringe intellectual-property, privacy, or other legal rights
  • Harass, threaten, defame, abuse, or discriminate against others
  • Upload malicious code or interfere with Site operation
  • Attempt to gain unauthorized access to an account, server, system, or network
  • Circumvent Site security or purchase restrictions
  • Manipulate prices, discounts, bundles, inventory, or cart data
  • Collect personal information without authorization
  • Send spam, phishing messages, or deceptive communications
  • Scrape or copy the Site through unauthorized automated means
  • Impersonate another person or business
  • Use PES content or product information to create misleading or counterfeit listings
  • Purchase products for an unlawful use

Standard indexing by legitimate public search engines is not prohibited.

We may suspend access, cancel orders, or take other reasonable action when these restrictions are violated.

13. Intellectual Property

The Site and its content are owned by or licensed to Pressure Equipment Sales LLC and are protected by applicable intellectual-property laws.

Protected content may include:

  • PES names, logos, and trademarks
  • Product photography and videos
  • Labels and packaging designs
  • Graphics and illustrations
  • Product descriptions
  • Guides and written content
  • Website design and code
  • Downloads and documents
  • Marketing materials

You may use the Site for personal or legitimate commercial purchasing purposes. You may not reproduce, republish, distribute, modify, sell, sublicense, or commercially exploit PES content without prior written permission.

Third-party trademarks, product names, and content remain the property of their respective owners.

14. Reviews, Feedback, and Customer Content

If you voluntarily submit a review, photograph, video, testimonial, comment, suggestion, or other content, you represent that:

  • You created or have permission to submit it.
  • It is accurate and reflects your genuine experience.
  • It does not infringe another person’s rights.
  • It does not contain unlawful, defamatory, deceptive, obscene, or malicious material.
  • It does not contain confidential information or malicious code.

You retain ownership of your content. You grant PES a non-exclusive, worldwide, royalty-free license to store, reproduce, display, format, and use that content in connection with the Site, PES products, customer service, and PES marketing.

We may moderate or remove customer content that violates these Terms. We are not required to publish every submission.

15. Third-Party Services and Links

The Site may use or link to third-party services, including Shopify, payment processors, shipping carriers, social-media platforms, review providers, maps, and other tools.

Third-party services are governed by their own terms and privacy policies. PES is not responsible for the independent operation, content, security, availability, or practices of unaffiliated third-party websites and services.

A third-party link does not necessarily constitute an endorsement.

16. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Transactional communications relating to orders, payments, shipping, safety notices, recalls, returns, or customer-service requests may be sent as necessary to complete a transaction or address an account or product issue.

Marketing communications are subject to the consent and unsubscribe options provided when customers subscribe.

17. Site Availability and Corrections

We do not guarantee that the Site will always be uninterrupted or free from technical errors.

We may maintain, modify, suspend, or discontinue Site features when reasonably necessary. We may also correct product, pricing, inventory, shipping, promotional, or typographical errors.

Nothing in this section eliminates an obligation to issue a legally required refund or correct information that applicable law requires us to provide.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS GENERAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PES DOES NOT WARRANT THAT THE SITE WILL ALWAYS BE UNINTERRUPTED, SECURE, OR FREE FROM TECHNICAL ERRORS.

Any express product warranty applies only when it is specifically provided in writing by PES or the product manufacturer.

Results from detailing products may vary based on surface condition, prior treatments, preparation, application method, dilution, temperature, storage, environmental conditions, and other factors outside PES’s control.

Nothing in these Terms excludes or limits a warranty, remedy, or consumer right that cannot legally be excluded or limited.

19. Limitation of Liability

To the maximum extent permitted by applicable law, PES will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the Site or products.

To the maximum extent permitted by applicable law, PES’s total liability for a claim relating to an order or product will not exceed the amount paid for the specific order or product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other obligations that applicable law does not permit us to exclude.

Nothing in these Terms eliminates a customer’s non-waivable legal rights or an applicable written product warranty.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Pressure Equipment Sales LLC and its officers, employees, and agents from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your unlawful conduct
  • Your material violation of these Terms
  • Your intentional misuse or unauthorized alteration of a product
  • Your infringement of another party’s rights
  • Content you submit without the required rights or permission
  • Fraudulent or unauthorized use of the Site

This section does not require you to indemnify PES for PES’s own negligence, willful misconduct, or violation of law.

21. Suspension and Termination

These Terms remain effective while you use the Site.

You may stop using the Site at any time. We may suspend or terminate access when we reasonably believe a user has violated these Terms, committed fraud, created a security risk, or engaged in unlawful conduct.

Termination does not eliminate rights or obligations that arose before termination, including payment obligations, refund rights, intellectual-property provisions, and provisions intended to survive termination.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law principles.

Before filing a formal claim, you and PES agree to make a reasonable effort to resolve the dispute by contacting the other party and providing a description of the issue and requested resolution.

Subject to any rights or venue requirements that cannot legally be waived, disputes relating to these Terms, the Site, or an order will be brought in a state or federal court with jurisdiction in Maricopa County, Arizona.

Nothing in this section prevents an eligible claim from being filed in small-claims court or eliminates consumer protections that cannot legally be waived.

These Terms do not require arbitration and do not contain a class-action or jury-trial waiver.

23. Changes to These Terms

We may update these Terms to reflect changes in the Site, products, operations, policies, or legal requirements.

The updated version will be posted on this page with a revised “Last updated” date. Changes apply prospectively to the extent required by law.

Continued use of the Site after an update constitutes acceptance of the revised Terms where permitted by law.

24. Severability and Waiver

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed without affecting the remaining provisions.

A failure by PES to enforce a provision does not waive our right to enforce it later.

25. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between the customer and PES concerning use of the Site and online purchases, except for any separate written agreement signed by PES.

If a product-specific written warranty, promotion, or agreement conflicts with these Terms, the more specific provision controls for that product, promotion, or transaction.

Translations may be provided for convenience. If a translation conflicts with the English version, the English version controls to the extent permitted by law.
